HD Construction Equipment Hyundai North America Social Media Contest Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. VOID WHERE PROHIBITIED BY LAW.
1. Eligibility
Residents of Canada and other international jurisdictions are not eligible to enter due to varying provincial, territorial, international contest registration, bonding, language, and regulatory requirements that apply outside the United States. Employees, officers, directors, representatives, agents, subsidiaries, affiliates, dealers, distributors, advertising agencies, promotional agencies, and immediate family members (spouse, parents, children, siblings, and their respective spouses) and household members of each are not eligible to participate or win. The Contest is subject to all applicable federal, state, and local laws and regulations.
2. Sponsor
The Contest is sponsored by HD Construction Equipment Hyundai North America, located at 6100 Atlantic Boulevard, Norcross, Georgia 30071-1305.
3. Agreement to Official Rules
By participating in the Contest, entrants fully and unconditionally agree to and accept these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest.
Winning a prize is contingent upon fulfilling all requirements set forth herein.
4. Contest Period
Each Contest will begin and end on the dates and times stated in the applicable social media contest post (“Contest Period”).
Entries submitted before or after the stated Contest Period will not be eligible.
Sponsor’s computer and social platform clocks are the official timekeeping devices for the Contest.
5. How to Enter
Entrants may enter by responding to the contest prompt, question, or instructions published on Sponsor’s official social media channels during the applicable Contest Period.
Limit one (1) entry per person, per email address, per social media account, and per household unless otherwise stated in the contest post.
Entries generated by script, macro, bot, automated means, or fraudulent methods are void.
By submitting an entry, entrant certifies that:
- The submission is original;
- The entrant owns or has permission to use all submitted content;
- The submission does not infringe upon the rights of any third party; and
- The submission does not contain unlawful, offensive, defamatory, or inappropriate material.
Sponsor reserves the right to disqualify any entry that violates these Official Rules.
No purchase is necessary to enter or win.
6. Winner Selection and Judging
At the conclusion of the applicable Contest Period, one (1) or more potential winners will be selected in a random drawing from among all eligible entries received during the Contest Period.
The random drawing will be conducted by Sponsor or its authorized representative.
Odds of winning depend on the total number of eligible entries received.
Sponsor reserves the right to select alternate winners if:
- A selected winner cannot be contacted;
- A selected winner fails to respond within five (5) calendar days;
- A selected winner is found ineligible; or
- A selected winner fails to comply with these Official Rules.
7. Winner Notification
Potential winners may be notified via social media comment, direct message, tag, email, or other method determined by Sponsor.
Potential winners may be required to provide:
- Full legal name;
- Mailing address;
- Proof of eligibility; and
- A signed affidavit/release where permitted by law.
Failure to respond within the required timeframe may result in disqualification and selection of an alternate winner selected in a random drawing from the remaining eligible entries.
If a winner is at least eighteen (18) years old but considered a minor under the laws of his or her state of residence, Sponsor reserves the right to award the prize to the winner’s parent or legal guardian.
Prizes will generally be fulfilled within approximately four (4) to eight (8) weeks following winner verification.
8. Prizes
Prize descriptions, approximate retail values (“ARV”), and quantity of prizes will be described in the applicable contest post.
Prizes are non-transferable and no substitution or cash redemption is permitted except at Sponsor’s sole discretion.
Sponsor reserves the right to substitute a prize of equal or greater value.
Winners are solely responsible for any federal, state, or local taxes associated with prize acceptance or use.
Sponsor is not responsible for lost, stolen, delayed, damaged, or misdirected shipments.
9. Publicity Release
Except where prohibited by law, participation in the Contest constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, social media username, city/state, photograph, voice, statements, and submitted content for promotional, advertising, and marketing purposes in any media worldwide without additional payment or consideration.
10. General Conditions
Sponsor reserves the right to cancel, suspend, modify, or terminate the Contest if fraud, technical failures, viruses, unauthorized intervention, platform outages, or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion.
Sponsor reserves the right to disqualify any individual who:
- Tampers with the entry process;
- Violates these Official Rules;
- Acts in a disruptive, abusive, deceptive, or unsportsmanlike manner; or
- Attempts to undermine the legitimate operation of the Contest.
Any attempt to deliberately damage any website or undermine the legitimate operation of the Contest may violate criminal and civil laws. Sponsor reserves the right to seek damages and remedies to the fullest extent permitted by law.
11. Release and Limitations of Liability
By participating in the Contest, entrants agree to release and hold harmless Sponsor, its parent companies, subsidiaries, affiliates, dealers, distributors, advertising and promotional agencies, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Contest or receipt, use, or misuse of any prize.
Sponsor is not responsible for:
- Incorrect or inaccurate information;
- Technical failures of any kind;
- Unauthorized human intervention;
- Lost, interrupted, or unavailable network or platform connections;
- Failed, incomplete, garbled, or delayed entries; or
- Any injury or damage resulting from participation in the Contest.
12. Social Media Platform Disclaimer
This Contest is in no way sponsored, endorsed, administered by, or associated with:
- or any other social media platform used to promote the Contest.
By entering, participants understand they are providing their information to Sponsor and not to any social media platform.
14. Governing Law
The Contest and these Official Rules shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.
Any disputes arising under these Official Rules shall be resolved exclusively in the state or federal courts located in Georgia.
